Terms of Service

These Terms of Service are a legally binding agreement between you and DigitalCarbon, Inc. governing your access to and use of aloworld, including the mobile app, web app, server APIs, AI conversation features, voice features, and related services.

By creating an account, signing in, or using aloworld, you agree to these Terms. If you do not agree, do not use the service.

What aloworld is

aloworld is an AI English-practice service. It lets learners practice English through chat and voice conversations with AI-generated practice partners.

The service may include:

• AI-generated character conversations
• voice messages and voice calls
• speech-to-text transcription
• text-to-speech character audio
• conversation feedback, translation, sentence help, and progress reports
• account, profile, safety, reporting, and deletion tools

aloworld is not:

• a real-person messaging service
• a human tutoring, certification, or test-prep service
• a therapy, crisis, emergency, medical, legal, or financial advisory service
• a service for children or minors

AI responses may be inaccurate, incomplete, unsafe, or inappropriate despite our safeguards. Use your own judgment and do not rely on aloworld for critical decisions.

Eligibility

You must be at least 18 years old and legally able to agree to these Terms to use aloworld.

You may not use aloworld if:

• you are under 18
• your use would violate applicable law
• your account has been suspended or terminated
• you are barred from using the service by law, platform policy, or these Terms

Accounts

To use some features, you must create an account through a supported sign-in method.

You are responsible for:

• providing accurate account information
• keeping your account credentials secure
• all activity under your account
• promptly telling us if you believe your account has been compromised

You may not share your account, sell access to your account, or let another person use your account as their own.

Account deletion

You may delete your account from the profile area in the product.

Deletion removes or schedules deletion of associated account, profile, chat, voice, and safety records, subject to backup latency, legal obligations, fraud prevention, abuse investigations, and the retention rules described in the Privacy Policy.

If you cannot access your account, use the request path described in the Privacy Choices page.

Paid features

aloworld may offer free, trial, or paid features now or in the future. If a paid feature is offered, the applicable price, renewal terms, cancellation path, and platform payment terms will be shown before purchase.

If a purchase is processed by Apple, Google, Stripe, or another payment platform, that platform's billing, cancellation, and refund rules may also apply.

Acceptable use

You must follow the Acceptable Use Policy.

You may not use aloworld to:

• generate, request, or share sexual or explicit content
• sexualize, romanticize, exploit, or roleplay minors
• encourage self-harm, suicide, violence, abuse, or serious illegal activity
• generate hateful, harassing, threatening, or defamatory content
• impersonate real people or mislead others about identity
• request medical, legal, financial, emergency, or crisis advice as if the AI were a professional
• upload or transmit content that you do not have rights to use
• try to jailbreak, reverse engineer, overload, scrape, or disable safety controls
• use automation, bots, scripts, or bulk access without our written permission

We may restrict or remove content, characters, conversations, accounts, or features when needed for safety, abuse prevention, platform compliance, or legal reasons.

User content

You retain ownership of content you submit to aloworld, including text, voice recordings, transcripts, reports, and feedback.

By using aloworld, you grant DigitalCarbon, Inc. a limited, worldwide, non-exclusive, royalty-free license to host, process, store, transmit, display, analyze, and create technical derivatives of your content as needed to:

• provide and personalize the service
• generate AI responses and audio
• transcribe and assess speech
• provide feedback and progress features
• secure, debug, moderate, and improve the service
• comply with law and platform requirements

You must have the rights needed to submit any content you provide.

AI and third-party services

aloworld uses third-party providers for AI text generation, speech recognition, speech assessment, text-to-speech, authentication, hosting, storage, analytics, and app delivery.

By using AI, voice, and feedback features, you understand that your messages, voice recordings, transcripts, profile context, and related metadata may be processed by those providers as needed to provide the feature.

The current named providers that process end-user data are listed in the Subprocessors page.

Our content and intellectual property

aloworld, including its software, design, character assets, interface, prompts, generated character profiles, logos, audio assets, and other product content, is owned by DigitalCarbon, Inc. or its licensors and is protected by intellectual property laws.

These Terms do not transfer ownership of aloworld or our content to you.

Feedback

If you send us feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation to you.

Suspension and termination

We may suspend, restrict, or terminate your access at any time if:

• you violate these Terms or the Acceptable Use Policy
• your use creates safety, abuse, fraud, platform, or legal risk
• we are required to do so by law, regulation, or app-store policy
• continuing to provide the service would create operational or security risk

You may stop using aloworld at any time and may delete your account through the product.

Sections that by their nature should survive termination will survive, including intellectual property, user-content license, disclaimers, limitation of liability, indemnity, and dispute provisions.

Disclaimers

aloworld is provided on an as-is and as-available basis.

To the maximum extent permitted by law, DigitalCarbon, Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, and accuracy of AI output.

aloworld is for language practice and general educational support only. It does not provide professional language certification, medical advice, legal advice, financial advice, crisis support, or emergency services.

Limitation of liability

To the maximum extent permitted by law, DigitalCarbon, Inc., its affiliates, officers, directors, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, business opportunity, or other intangible losses arising from or related to aloworld.

To the maximum extent permitted by law, our total liability for claims arising out of or related to aloworld will not exceed the greater of the amount you paid to aloworld in the 12 months before the claim or USD 100.

Nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to defend, indemnify, and hold harmless DigitalCarbon, Inc. and its affiliates, officers, directors, employees, contractors, agents, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

• your use of aloworld
• your content
• your violation of these Terms
• your violation of law or third-party rights

Governing law and disputes

These Terms are governed by the laws of the State of California, excluding conflict-of-laws rules, unless mandatory local law requires otherwise.

Any dispute arising from or related to these Terms or aloworld will be resolved in the state or federal courts located in San Francisco County, California, unless mandatory law requires a different forum.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may notify users in-product, by email, or by updating the effective date above.

Your continued use of aloworld after changes become effective means you accept the updated Terms.
